Sydney Pool Servicing – Terms and Conditions of Service

1. Definitions
1.1 "We", "our", "us" or "Sydney Pool Servicing" refers to Mobility Scooters Pty Ltd trading as Sydney Pool Servicing Company.
1.2 "You" or "the client" refers to the individual or entity receiving services from us.
1.3 "Services" means any pool-related services provided by us, including but not limited to: regular servicing, one-off visits, equipment installation, leak detection, green pool clean-ups, repairs, and consultations.
1.4 "Engagement" means any agreement, oral or written, between you and us for the provision of services.
2. Scope of Services
2.1 These Terms and Conditions apply to all services provided by us, whether recurring or one-off.
2.2 Recurring services are billed at a fixed monthly rate and cover standard servicing only. Chemicals, parts, or additional labour (e.g. green pool treatment, repairs) are not included and will be charged separately.
2.3 One-off services will be quoted separately and confirmed prior to commencement unless otherwise agreed.
3. Quotes, Bookings & Engagement
3.1 A request for services constitutes your offer to engage us. An engagement is confirmed when:
You accept our quote or job confirmation in writing, or
We begin providing services at your request.
3.2 All quotes remain valid for 14 days unless otherwise stated.
4. Access & Safety
4.1 You must ensure our staff have safe, unobstructed access to the pool area during the scheduled service time, including:
Unlocked gates
Secured pets
No safety hazards (e.g. exposed wiring, loose tiles)
4.2 If we cannot access your pool due to unsafe conditions or locked gates, a $90 callout fee will apply.
5. Cancellations & Weather Policy
5.1 You must provide at least 24 hours’ notice to cancel a scheduled service. Same-day cancellations may incur a $90 fee.
5.2 In the event of poor weather (e.g. heavy rain), we may delay servicing. If you are on a fixed-fee plan:
Your scheduled visit will be rescheduled at the next available opportunity.
Regular payments will continue, as the service will be made up.
6. Service Documentation
6.1 Upon completion of a job, we will provide a job service report outlining the work completed. Reports may include notes and/or photo evidence.
6.2 These reports serve as proof of service. If you believe work was not completed satisfactorily, you must notify us within 7 days.
7. Your Responsibilities
7.1 You agree to provide accurate information about your pool, equipment, and access conditions.
7.2 You are responsible for notifying us of any known issues that may affect service delivery.
8. Payments & Fees
8.1 Payment is due on receipt of invoice unless otherwise agreed in writing.
8.2 For equipment installs or large jobs, we may require a deposit or partial payment upfront.
8.3 Overdue invoices may incur:
Late fees
Interest
Debt recovery costs
8.4 Disputes regarding invoices do not suspend your obligation to pay.
9. Subcontracting
9.1 We may engage qualified subcontractors (e.g. electricians, plumbers, leak detection specialists) to perform part of the Engagement.
9.2 We remain the primary contractor and will manage all subcontracted work under our terms.
10. Liability
10.1 We are committed to high standards of service. However, in the event of a proven fault directly caused by our negligence, our liability is limited to the amount you paid for the specific job or project.
10.2 We are not liable for:
Damage caused by incorrect or incomplete information provided by you
Pre-existing faults in equipment or structures
Indirect, consequential, or business losses
10.3 Liability for subcontracted work is subject to the same limitations.
10.4 Each case will be reviewed individually. Remedies may include a re-service, partial refund, or other resolution at our discretion.
11. Privacy & Data
11.1 We only collect personal information necessary to perform our services: name, address, contact details.
11.2 Your data may be stored in secure cloud-based platforms (e.g. Xero, Jobber, Servicem8) in accordance with Australian privacy laws.
11.3 We do not sell or share your personal information with third parties except as required to complete the service or comply with the law.
12. Termination
12.1 You may cancel your recurring service at any time with 7 days' notice in writing.
12.2 We reserve the right to terminate our services immediately for:
Non-payment
Repeated cancellations
Unsafe access or conduct
13. Force Majeure
13.1 We are not responsible for delays or failures caused by events beyond our control (e.g. weather, illness, equipment failure).
14. Governing Law
14.1 These Terms and Conditions are governed by the laws of New South Wales, Australia.
15. Updates to Terms
15.1 We may amend these Terms from time to time. The current version will always be available on our website or by request.
16. Travel Expenses
16.1 Travel beyond 40km: If a service requires us to travel more than 40km from our base in Brighton Le Sands, we may charge you a fuel fee of $0.99 per kilometer for the distance beyond 40km.
16.2 Toll Roads: We may also charge for any toll road usage incurred during travel to and from the service location.
16.3 Not Included in Quote: These travel-related charges may not be included in your service quote and will be billed separately.
